1. Introduction
Welcome to PublicServiceArchive ("we," "us," or "our"). The use of our yacht rental services and website at publicservicearchive.top (our "Service") is governed by the following Terms & Conditions ("Terms").
Your agreement to these Terms is required for the reservation or use of our Service. If you do not accept any portion of these terms, you are not permitted to use the Service.
2. Service Overview
PublicServiceArchive offers high-end yacht hiring services, which include, but are not limited to:
- Day-long yacht hires
- Evening boat tours
- Company getaway trips
- Exclusive celebrations
- Extended yacht hires
Our services are subject to both availability and climatic conditions. We retain the authority to change or cancel services without notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you need to:
- Be of minimum 18 years of age
- Submit accurate and comprehensive information
- Remit the necessary deposit as outlined in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking will occur once payment is complete and we provide written affirmation. We reserve the right to decline service to any individual at our discretion.
3.3 Availability
Charter trips are contingent upon the vessel's availability and favourable weather conditions. We will endeavour to adapt to your preferred scheduling.
4. Payment Terms
4.1 Pricing
Prices are expressed in € and include taxes unless stated otherwise. Prices may be changed with no prior notification.
4.2 Payment Schedule
- Deposit: Half of the full charter cost is due upon reservation
- Balance: To be paid 48 hours prior to the departure of the charter
- Additional fees (if applicable): Payable at the end of the charter
4.3 Payment Methods
Payments are accepted via major credit cards, bank wire transfers, and certified checks. Payment processing will be conducted through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Full refund minus transaction fees for cancellations made over 72 hours before departure
- Half refund for cancellations made between 24 to 72 hours before departure
- No refund if the cancellation occurs less than 24 hours before departure
5.2 Weather Cancellations
Should our captain determine that the weather conditions are unsafe, we will propose to:
- Reschedule the charter at no extra charge
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
If mechanical complications arise with the designated yacht, we will make efforts to arrange a comparable alternative. If no alternative can be provided, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Follow directions given by the crew
- Utilize necessary safety gear when instructed
- Inform us of any medical issues that could impact their safety
- Stay within the designated sections of the yacht
6.2 Prohibited Items
It is not allowed to bring the following on board:
- Glass containers
- Illegal materials
- Weapons or firearms
- Excess quantities of non-alcoholic drinks beyond reasonable consumption
- Pets (except with previous authorization)
6.3 Conduct
Passengers are expected to behave with respect at all times. Any guest conduct that creates a risk to safety or interferes with the experience of others may result in the immediate cessation of the charter without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our responsibility to the value spent on your charter. We will not be held accountable for:
- Personal injuries due to passenger carelessness
- Loss or harm to personal belongings
- Indirect or secondary damages
- Delays caused by weather conditions or other factors out of our control
7.2 Insurance Coverage
Our marine insurance coverage is comprehensive and includes our vessels and operations. It is your responsibility to ensure travel and personal insurance.
7.3 Assumption of Risk
When you partake in our charters, you accept the inherent dangers associated with maritime activities and take responsibility for your safety and health.
8. Modifications and Itinerary Changes
We retain the right to alter itineraries, paths, or timetables based on climatic conditions, safety needs, or operational demands. We will strive to provide alternative experiences of a similar quality.
9. Force Majeure
We shall not be held liable for any delays, cancellations, or changes brought about by forces beyond our control, including but not confined to:
- Severe meteorological conditions
- Natural disasters
- Regulatory enactments
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
How we manage your personal data is consistent with our Privacy Policy. Your utilization of our Service implies your consent to our information collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
Content on our website, including but not limited to text, graphics, logos, and imagery, is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our explicit permission.
12. Governing Law
The applicable laws of Monaco will govern these Terms. Conflicts will be resolved in the courts situated in Monte Carlo, Monaco.
13. Changes to Terms
We retain the right to revise these Terms at any time. Updates will be published on our website with a new date of revision. Continued Service use denotes an acceptance of these updated terms.
